Big arguement going on right now between the owner of Casinomeister (CM) and the owner of GamblingForums (GF):

To say it in a few sentences. CM is accusing GF of stealing its content. It's not articles or reviews its accusing GF of taking. Its the public posts made on the CM forum by its members!

Of course GF isn't taking whole threads, but rather just the first post which is made by the OP on CM, and it is reproducing it on its own forum! It's not just doing this with CM either, but any forum that uses an RSS (some tool which synchronizes their forum content). If you've ever started a thread on another forum that uses an RSS, your post could appear on GF!

Now CM says that GF is stealing its content and is demanding it to be removed. GF says that it doesn't have to because whenever an OP's post is taken,
the source is included in a link (which goes back to CM). Hence because it is including the source references within the copied post, then it is not doing anything illegal.

Any thoughts on whose right, wrong?

I personally feel like what GF is doing might kill any potential reputation they might otherwise have/had because its definitely shady....But illegal? And can CM
say that its "their" content being taken when me/others are the ones who are writing/creating these posts? How can CM accuse GF of content theft when its the forum members who are writing these posts?

There are actually two copyright issues involved in such a case.

The person who writes a post has the copyright to it. He is free to post it anywhere he wants to unless his post has been purchased by the initial publisher (in this case, CM) but no other publisher has the right to use it without the initial poster's permission. (This does not apply to short sections from it, which makes it a "fair use" issue.)

The second issue is the overall content of a site. That belongs to the publisher. If I were to copy a thread from CM and post it on another site, I would be guilty of violating CM's copyright. In fact, if I were to copy a single post from CM's site but include headers or graphics that CM included, I would also be guilty of violating his copyright.

In short, with the exception of "fair use" matters, I would need the original poster's permission to copy his work and could not include anything that CM, or other posters on CM's site added to that post.

There are two exceptions to this. As the initial publisher, CM could give permission to copy any post on his site even if the original poster does not. The second exception is information -- that cannot be protected by copyright, only the manner of expressing that information can.

Hence, if someone discovers that the owner of Cheat Now Casino has made no payments to any players and publishes that fact on CM or anywhere else, that information, in itself, enjoys no copyright protection. However, the person who makes that post does own the copyright to the wording he used in revealing the information.

Just as an off-topic point of information, as the manager of Gambling Grumbles, I allow any person or site to copy anything that is posted on GG under condition that GG is clearly shown as being the original site for it or a link is provided to the GG report.

Based on this, what their doing is illegal. They're not copying any of the originating website's own content. They provide a source link under each copied post (however you won't know where it came from until you click the link).

I suspect most forum posters won't care if something they post on a public forum is re-posted elsewhere (I wouldn't). However a few people might (clearly CM's owner does) and I think GF might be shooting any potential future reputation in the foot.

Ethics aside, I wonder if its a brilliant strategy because now they will have a ton of content and the website will rank higher in Google searches?

My thoughts are they should get permission before reposting another sites content, or the person who posted. This is IMO. I don't care if I get reposted but ask me first.
